California Unemployment Insurance Code § 1735

Legal Guidance from a San Diego Tax Attorney

According to California tax law, if you have the authority to pay a company's taxes but fail to do so, you are responsible for these unpaid taxes. This is delineated in Code § 1735 found below.

§ 1735 Payment of contributions or withholdings; personal liability; assessments; collection remedies.

An individual who has charge of the affairs of a corporation or other entity and willfully does not pay contributions required by this division by the delinquent date is personally responsible and liable for the full amount of the contributions, penalties, and interest that is unpaid by the employing entity. The director may asses the individual for the amount of contributions and extras owed.
